It's nearly 12 months since the Fair Work Act replaced the Work Choices legislation. Amongst the areas affected, changes were made to the unfair dismissal laws including changes to the procedures for dealing with claims. For instance, the new Act dispensed with some of the previous restrictions such as the 100 employee threshold and the 'operational reasons' exclusion. Due to changes in procedure, conciliation is most often conducted by teleconference rather than face to face and claims must be brought within 14 days of dismissal with very little ability for late claims to be accepted.
